Who you pay, and who pays the attorney

SPARK Reports and filing packages are sold by Montgomery IP Associates, the company that owns Patent Attorney Network.

When your order includes legal work, such as the Patentability Assessment in SPARK Legal and SPARK PRO, or preparing and filing your application, Montgomery IP pays the attorney for that work. The attorney's professional duties, including confidentiality and loyalty, are still owed to you, not to Montgomery IP. You'll be told about this arrangement in writing before you buy, and you can decline.

You don't have to buy from us. You can get a patent search from any provider, and you can ask the attorney for their own quote to file your application directly.

What a search can and can't tell you

A search shows you what's already been patented or published that looks like your idea. It can't guarantee that a patent will be granted, because the examiner at the USPTO makes that decision, and it can't tell you whether your product will sell.

A patentability assessment is an attorney's professional opinion on whether your idea looks patentable over what the search found, and what type of patent, if any, makes sense. Sometimes the honest answer is "don't file." That's a good outcome if it saves you thousands of dollars.
